King Kyle holds court as trial date set in legal stoush

After some fell over themselves to hear his thoughts, Kyle Sandilands says everyone should be sceptical of claims made about him in court.

The shock jock once again drew a throng of media to his latest court appearance on Friday, as both his and his co-star’s cases against their former employer got a trial date.

Sandilands and Jackie “O” Henderson are suing radio giant ARN following an on-air spat that blew up their hit show on KIIS FM.

After photographers stumbled trying to get a shot of Sandilands on his entrance and exit, he fired a shot of his his detractors, seemingly including his former colleague’s lawyer.

“Just don’t believe the bullshit that you hear and read, just wait till you see what comes out,” Sandilands told reporters before climbing into his luxurious Rolls-Royce.

Henderson’s lawyer Vanja Bulut earlier argued in court, with Sandilands watching on, the presenters’ cases should be split so the two did not have to share a room.

Sandilands’ barrister indicated his client is likely to admit a raft of explicit and offensive statements towards his co-host.

But the notorious radio host will argue ARN was well aware of his personality and made that behaviour a condition of his contract, his barrister said.

Scott Robertson SC argued the shock jock’s contract was unfairly terminated because he had a “special immunity” to outrageous conduct.

“Particular kinds of conduct … might be considered serious misconduct under workplace law but not when you consider the contract,” Mr Robertson said.

“If you buy Kyle, you get Kyle.”

Mr Robertson said headline-drawing outbursts were “contractually desired” by ARN and clips of arguments between the pair were monetised through posting on social media.

Sandilands allegedly said some of Henderson’s comments were “weird, psychological bullshit” and her belief in “hype words” was negatively impacting her dating life.

He allegedly made offensive comments to Henderson in September 2025 that prompted her to raise a complaint with station staff.

“Don’t f***ing bother coming back either until you get your f***ing shit together like a normal person,” Sandilands allegedly told Henderson off-air.

“I’ve been carrying this whole show for f***ing a year.”

Sandilands wanted the cases separated, with his barrister arguing it was necessary to allow his claim to be heard first in a bid to get him back on air sooner.

But ARN barrister Tom Blackburn SC argued there was too much overlap in the cases for them to proceed separately.

Justice Angus Stewart indicated he agreed with the ARN position to avoid inconsistent rulings being made based on similar evidence and witness accounts.

While a final decision on whether the cases will be heard separately is expected in May, both matters have been tentatively listed for a trial starting on October 12.

No reunion between the star pair took place in court, with only Henderson’s agent Gemma O’Neill present.

“I haven’t spoken to Jackie, I haven’t spoken to any of their people,” Sandilands told the throng of reporters while entering court.

The pair are both seeking the full payout of the remainder of their 10-year, $100 million contracts signed at the end of 2023.

But ARN claim in a countersuit the controversial pair cost the company key advertising revenue through their sacking.

In its defence to Sandilands’ lawsuit over his sacking, ARN told the court Henderson sent the station a letter in February claiming her co-host had engaged in “persistent and relentless bullying” over about six months.

Ms Bulut said evidence was expected to be called detailing the damage to Henderson’s health and wellbeing as a result of ARN sacking her.

The highly public bust-up moved into the legal arena after an exchange between the star pair in February, when Sandilands accused his co-host of being “off with the fairies”.

The on-air comments prompted Henderson to say she could no longer work with her contentious colleague.
