The ACT Government has taken a formal step towards terminating the Crown lease for the Big Splash Water Park, notifying the lessee that the Territory Planning Authority is considering ending the agreement.
Access Canberra, acting as the delegate for the Territory Planning Authority, issued a letter to the lessee on Friday advising that the Authority is considering terminating the lease for a contravention of Chapter 12 of the Planning Act 2023.
Under the Act, the Authority is required to issue the notice, which has been made under Part 12 of the legislation. The notice invites the lessee to respond in writing, outlining why the lease should not be terminated.
The Planning Act requires the Authority to consider any reasons provided by the lessee before making a final decision.
The lessee has 15 working days from the date the notice is received to respond, although the Authority may extend that timeframe.
Access Canberra said the matter is now an active regulatory issue and no further information can be released at this stage. Updates will be provided to the community as the process continues.
